Terms and conditions of sale and purchase
If you order from Estonia, you have more payment and delivery options. These terms and conditions apply to orders from other countries.
1.1 Applicability. These terms and conditions apply to sale and purchase agreements concluded by the buyer with Artonella OÜ (hereinafter referred to as the “seller”) for the purpose of ordering goods through the Artonella OÜ internet shop www.uneleja.ee. These terms and conditions are valid until 31.12.2018.
1.2 Entry into force. The sales and purchase agreement between the buyer and the seller for the purchase of the goods ordered by the buyer enters into force when the seller has acknowledged the order. The seller is considered to have acknowledged the order from the moment of sending a confirmation notice, at the latest when the ordered goods are delivered to the buyer.
1.3 Deadline to complete the order. If the buyer has chosen to pay using “Pay by invoice” or Paypal, the seller will begin to execute the order after the payment has been received. The seller will complete the order within eight to twenty working days after receipt of the payment. Should the expected time to complete the order for a specific product be longer than 20 days, the time needed to complete the order is indicated in the product description and also the buyer will be informed of the longer deadline by e-mail. If the buyer chooses delivery by courier, the order will be delivered to the buyer by DPD. The buyer will receive an SMS or e-mail message informing that the order has been sent. On the day when the goods have reached the DPD warehouse from which the delivery will take place, the courier will contact the buyer by telephone to agree on the delivery time. If the courier is unable to contact the buyer, a notice will be left in the mailbox with the request to contact the courier company.
If the buyer has chosen delivery to a post office, the order will be sent to the post office responsible for the buyer’s address.
1.4 Method of payment and price. The prices in the internet shop are in Euro and include 20% VAT. This applies to all orders from inside the European Union. In the case of orders from outside the European Union, no VAT is added to the final order.
The delivery price depends on the weight of the package and the destination and will be added to the price of the goods and will be shown on the invoice.
Orders for more than 195 EUR will be delivered free of charge.
1.5 Delivery of goods. The seller is obliged to deliver the goods ordered using the method of transportation selected by the buyer. If it is not possible to send the complete order at once, the seller will send the ordered goods to the buyer in several deliveries. In that case the delivery charge will not be increased.
1.6 Cancellation of the order. The buyer has the right to cancel the sale and purchase agreement without giving a reason up to 14 days after delivery of the goods to the buyer. To cancel the order the buyer must notify the seller by e-mail and subsequently return the goods to the seller. Upon cancellation of the order the buyer will refund the cost of the products after receiving the returned goods. The delivery charges will not be refunded. The returned goods must be unused and in unopened original packaging. If the returned goods are in worse condition than at delivery, the buyer is required to pay for the reduction in value of the goods.
1.7 The seller’s right to terminate the agreement. The seller has the right to terminate the sale and purchase agreement, if the seller does not have the ordered goods in stock.
1.8 Refund after termination of agreement. The seller refunds the purchase price of the goods to the buyer no later than 14 days after receiving the returned goods. The refund is credited to the bank account given by the buyer. If the buyer terminates the agreement, postage or courier fees are not refunded.
1.9 Warranty conditions. The seller gives the products ordered a warranty according to the law of the Republic of Estonia. The warranty is valid only together with the sales invoice or the order confirmation. In case a defect becomes apparent the buyer has the right to demand that the seller exchanges the product. If it is not possible to exchange the product, the buyer has the right to cancel the sale and purchase agreement. The warranty is not valid if the defect is caused by inappropriate or incorrect use or normal wear and tear.
1.10 Ownership. Until the products ordered have been paid for they belong to the seller.
1.11 Claims. The seller has the right to sell and to give as security to third parties claims which derive from the sale and purchase agreement concluded with the buyer. In case the buyer delays payment, the buyer has the right to collect fees for enforcing the claim, including legal expenses and collection services.
1.12 Limited liability. The seller is only liable for breaches of the sale and purchase agreement concluded on the basis of the order and for damages to the buyer due to the nature or the use of the products ordered if the cause of the damage is intent or gross negligence on the part of the seller.
Privacy policy
On placing an order in the Artonella webstore, the buyer enters into a buyer-seller relationship and as a consequence gives Artonella the personal data necessary to complete the transaction and gives Artonella permission to use this personal data as follows:
Artonella will register the personal data in its register of customers. The data will be used to provide sales services and to offer products to the buyer. The registered personal data of the buyer consists of family name, first name, street, house number, apartment number, municipality, postal/ZIP code, telephone number, means of transport and method of payment.
The buyer has the right to view personal data in the register, to change or delete it.
The buyer gives Artonella the right to send the order confirmation to the buyer’s e-mail.
Personal data which is necessary for sending the goods to the buyer may be given to the courier who is delivering the goods.
Artonella will not give personal data to any other persons, except for persons with the legal responsibility or right to receive them.
